Waiver and Release

While training at Vertical Movement for any scheduled classes or events:

I understand that physical exercise can be strenuous and subject to risk of serious injury or aggravation of underlying medical conditions, including up to death.

Attestation of Health

Prior to engaging in any exercise activities, I understand that a physical examination from a doctor is highly urged. I represent that I am in good health, and in proper physical condition to participate in the activity. Should I ever believe or receive information that any of the above representations have become untrue then it is my obligation to discontinue activities immediately.

Release, Indemnification, Liquidation, and Damages

I recognize that such physical activity and exertion may be difficult and strenuous and may cause or aggravate a physical injury or aggravate a pre-existing medical condition.

I agree that I engage in any physical exercise or activity, I do so entirely at my own risks.
This waiver and release of liability includes, without limitation; property damage and all injuries or damages, which may occur as a result of:

(a) participation in any activity or training session

(b) instruction and supervision by instructors while at Vertical Movement

(c) failure of any equipment or part of the equipment

(d) inherent risks of training equipment

(e) engaging in unsupervised activities in any part of the gym

I further acknowledge that the above list is not comprehensive and does not limit the extent or reach of this waiver.

I acknowledge that I have carefully read this “waiver and release” and fully understand that it is a release of liability. I agree to release and discharge the owner and instructors at Vertical Movement from any and all claims or causes of action, and agree to voluntarily give up or waive any right that may otherwise have to bring a legal action against Vertical Movement or its Instructors for personal injury or property damage, including but not limited to claims of negligence.

If a court of competent jurisdiction deems any portion of this release from liability invalid, then the remainder of this release from liability shall remain in full force and effect, and the offending provision or provisions severed here from.
